Marshalltown Council Amends Animal Keeping Ordinance, Allows Poultry on 5+ Acre Residential Properties
The council discussed amending city code Chapter 90 regarding animal keeping, specifically focusing on allowing poultry and domestic fowl on residential properties. The discussion centered on whether to maintain the current prohibition, allow it citywide on properties of a certain size (e.g., 2 or 5 acres), or create a specific zoning amendment for Appleberry Farms. Ultimately, the council voted to amend the code to allow the keeping of livestock, poultry, and domestic fowl on residential properties of five acres or more. A motion to exclude roosters was passed as an amendment. The council also voted to administratively extend the time for Appleberry Farms to remove their chickens until after the ordinance change is finalized through three readings.
Marshalltown Council Approves $77,000 Audit Services Agreement with ID Bailey LLP
The council approved Resolution No. R-2026-XX, authorizing an agreement with ID Bailey LLP for city audit services for the fiscal year ending June 30, 2026. The agreement, with a cost of $77,000, includes REACT procedures and coverage for up to two major federal programs. The finance director noted that extending the current agreement is necessary due to the upcoming year-end and the need to avoid delays in the audit process, which is required for receiving federal funds. Lane Perry suggested that the city plan to bid out audit services next year to explore other available options.
Marshalltown Council Rejects Data Center Moratorium, Opts for Development Agreement Requirement
The council discussed a proposed two-year moratorium on data center development. The moratorium was intended to allow staff and commissions to study the issue and develop specific regulations, as data centers are currently categorized broadly as 'major utilities' with no specific standards in the zoning code. Public comments and council discussions revealed significant division. Proponents of the moratorium cited concerns about water usage, power demand, environmental impact, and quality of life, urging a pause to establish clear rules and standards. Opponents argued that a moratorium sends a negative signal to businesses, hinders economic development by closing doors to potential investment and job creation, and misses the opportunity to negotiate favorable terms for the city through development agreements. Ultimately, a motion to implement a moratorium failed. A subsequent motion to direct staff to work with the Planning and Zoning Commission to develop ordinances and explore banning data centers of 10 megawatts or more also failed. A final motion to direct staff to work with the Chamber of Commerce on establishing development agreements for such projects passed.
Council Approves Assessment of Former Hospital Property, Explores Redevelopment Potential
The council discussed a proposal to fund a phased professional assessment of the former hospital property, which the city recently acquired title to. The assessment, proposed in partnership with the Marshalltown Area Chamber of Commerce and to be conducted by engineering firm ISG, would begin with a preliminary review of the building's condition and potential redevelopment options. The goal is to determine if any structural integrity exists for reuse or if selective demolition is feasible, potentially saving the city costs compared to full demolition. The first phase is estimated to take 10 weeks. The council authorized the Chamber of Commerce and the engineering firm to access the property for the assessment.
Marshalltown Approves $574,000 Change Order to Expand 2026 Street Rehabilitation Project
The council discussed and approved Resolution No. R-2026-XX, which approves Contract Change Order No. 1 for the 2026 Street Rehabilitation Project (HMA Project No. STR2602). This change order increases the project cost by $574,092.65, utilizing remaining funds in the project budget to include additional streets. The project aims to resurface streets identified as needing rehabilitation, extending work in areas already being addressed to optimize contractor efficiency. The change order includes work on First Street, Fourth Street, Fifth Street, Nevada Street, and other connecting sections. Public works provided an update on current construction progress, including milling and upcoming asphalt work, and advised residents on traffic access and parking restrictions.
