Zoning Board Approves Conditional Use for Tobacco Store Relocation
The Zoning Board of Adjustment approved a conditional use permit for a tobacco store, Central Iowa Vapor South LLC, at 4814 Southwest 9th Street. The business is relocating from a nearby site and will occupy a 1500 square foot tenant bay in a recently constructed strip commercial center. Staff recommended approval with 11 conditions, including maintaining the specific tenant space and allowing the zoning officer to bring the permit back for reconsideration if issues arise. The applicant agreed to the conditions and proposed operating hours of 10 a.m. to 8 p.m. Monday-Saturday and 12 p.m. to 6 p.m. on Sundays. The board approved the request with a friendly amendment to include the agreed-upon hours as a condition in a 6-0 vote.
Zoning Board Denies Variance Request for Opaque Fencing at Auto Salvage Yard
The Zoning Board of Adjustment heard a request for a variance to modify an existing conditional use for a junk and salvage yard at 1623 East 17th Street. The applicant, Dudah LLC represented by Mike Swift, sought to vary the requirement of an eight-foot tall opaque fence for outdoor storage along the east and south property lines, maintaining an existing chain-link fence instead. Staff recommended denial, citing the applicant's failure to demonstrate hardship and meet variance criteria, as well as the violation of a condition from a previous approval in 2021 that required the opaque fence. The board ultimately denied the variance and the amendment to the conditional use in a 6-0 vote.
