Fairway Franks Receives Site Plan Approval for Outdoor Sunshade

The City Council approved a resolution approving the site plan for 729 Main Street, allowing Fairway Franks to add a sunshade over their outdoor seating area. This required a site plan amendment. Staff noted that the addition involves minimal structural changes (poles and canvas) and does not violate zoning ordinances. A question was raised about ensuring the existing deck and stairs meet code, and staff committed to checking with the building official. The addition is expected to provide a nice shaded area for patrons.

Parking Waiver Approved for 1060 Madison Street with Conditions After Previous Revocation

The City Council approved a resolution approving a parking waiver for property at 1060 Madison Street, owned by Dunn Industrial Condominiums. Initially, a waiver was granted based on representations of practices-only use, limited to 27 parking spaces. However, the occupants reportedly held events exceeding this limit and installed flooring and port-a-potties before receiving a certificate of occupancy. Consequently, the council revoked the initial waiver and referred it to the Planning and Zoning Commission. P&Z recommended an additional 30 parking spaces, achievable by striping the current concrete, with a recommended waiver based on owners' representations of not exceeding 215 occupants and 57 parking spaces. The Mayor emphasized the waiver is not an entitlement and can be revoked if terms are violated. The resolution includes conditions on occupancy and parking, and the waiver is contingent on the certificate of occupancy.

Hackney Hills Development Approves Architectural Changes for Housing Units Due to Retaining Wall Failure

The City Council addressed a potential issue with a retaining wall above a stormwater detention pond in the Hackney Hills plat one development. The developer proposed removing the retaining wall and creating a sloped grade to the housing units, which would result in a different architectural look, including walkout lower-level units. This change was deemed necessary due to repeated failures of the retaining wall. Geotechnical engineers provided analysis on the soil stability and the proposed construction methods for the new units. The council approved the architectural amendment to proceed with the developer's proposed solution, contingent on meeting code requirements and further soil analysis. The developer also offered a donation to the North Parks Department, though this was handled separately from the plat approval.

Norwalk City Council Repeals Building Permit Fee Waiver for School District

The City Council voted to repeal the Norwalk Community School District building permit waiver policy, which was established in November 2018. Staff recommended the repeal because the cost of building permits should cover the city's work involved in issuing and inspecting them. Waiving these fees spreads the cost to other permit holders. The policy had resulted in approximately $150,000 in waived fees and significant staff time over six years. The City Manager had discussed this with the School Superintendent, who understood the city's perspective. The repeal means the school district will now pay standard permit fees for future projects.

Central Iowa Waterworks Agreement Amended by City Council

The City Council discussed and approved amendments to the Central Iowa Waterworks 28E/28F agreement, revising provisions related to board weighted voting, meeting notices, the establishment of two-year terms for committee chairs, the composition of the finance and audit committee, and the allocation of tax-exempt bond issuances among member agencies for federal bank qualified designation purposes. The amendments were presented and approved without significant council discussion or public input.
