Dalton Approves Retirement Plan Fee Reduction, Saving Participants Costs
Human Resources requested approval for a contract amendment with Empower, the city's retirement plan administrator. The amendment, negotiated by Human Resources, will reduce record-keeping fees for the city's 457B and 401a plans from 0.27% to 0.23%. This fee reduction is for a three-year commitment period and lowers administrative costs for plan participants without changing the services provided. The city attorney reviewed the agreement. The council approved the amendment.
Dalton Council Adopts Updated Fire Prevention and Protection Code
Ordinance 26-13, concerning fire prevention and protection, was presented for its second reading. This ordinance updates Chapter 54 of the revised code by deleting the existing Article 2 (Fire Prevention Code) and adding a new Article 2. The update aims to clarify language related to the alcohol ordinance, define specific occupancies more clearly, strengthen the connection between local, state, and fire marshal standards, and ensure consistent application of fire protection language. The council approved the ordinance.
Dalton Council Approves Amendments to Alcohol and Business Codes, Including Event Facility Licensing
The council reviewed and amended Ordinance 26-12, which modifies Chapter 6 (alcoholic beverages) and Chapter 26 (businesses) of the City of Dalton's revised code. Key changes include definitions for 'event center' and 'restaurant,' modifications to subsections concerning possession in public places, and eligibility for pouring licenses. A significant addition is Article 11 to Chapter 26, establishing licensing for 'event facilities.' Fees for event facility licenses were reduced from $2,000 to $500. A provision was added to Section 26403 to exempt 'grandfathered establishments' from certain application requirements not pertinent to them. Section 26407C concerning grandfathering was moved to 26414 and expanded to include establishments operating legally non-conformingly due to parking or zoning, not just distance requirements. The ordinance passed its second reading.
Dalton Renews Memorandum of Understanding with North Georgia Tennis Association
The council reviewed a Memorandum of Understanding (MOU) with the North Georgia Tennis Association (NOGTA). This MOU is a renewal of a previous agreement that had not been formally executed since 2022. The purpose of re-establishing the MOU is to ensure both the city and NOGTA are on the same page regarding expectations and responsibilities. The agreement is designed to renew automatically unless issues arise. The council approved the MOU.
Dalton Council Approves Rezoning with Driveway Modification for Tibbs Road Property
The Mayor and Council considered the second reading of Ordinance 26-10, which addressed a rezoning request from Debo's Diner Investments LLC to rezone 3.42 acres at 525 and 527 South Tibbs Road. The ordinance included a substitute that repealed and replaced Condition 4 from the original 2008 rezoning ordinance (Ordinance 08-11). The new Condition 4 requires the current access to the property on Tibbs Road to be modified to be right-in, right-out only, with a new access point constructed approximately 150 feet north of the current access, all in compliance with city standards. This change was motivated by a desire to improve site distance, with the new location providing approximately 400 feet of site distance in each direction, doubling the current site distance and aligning with engineering standards. The Planning Commission had previously recommended approval, and staff also supported the revision. The council approved the ordinance.
