Variance Requested for 1-Acre Lot Subdivision from 3-Acre Minimum
The applicant requested an area variance for lot area, proposing 1 acre where 3 acres are required for a subdivision. The property is zoned R3. The applicant wishes to subdivide a house off the farm to sell it for care costs and maintain the surrounding farmland. The proposed lot is nearly square to accommodate drainage ditches and has 225 feet of road frontage. Neighbors have signed letters of approval. The property has public water and a new septic system. The requested variance is from the 3-acre requirement [cite: 51-91, 102-127, 130-131, 136-137, 140-141].
Generator Installation Requires Setback Variance
The applicant requested a 1.1 ft side setback variance for the installation of a generator. The variance is needed to place the generator 1.1 feet over the property line due to code requirements. Specifically, generators cannot be placed within five feet of a window or vent. The proposed location is near an egress window, a fireplace vent, and other utilities. There are no neighbors on the side of the house where the variance is requested. The HOA has provided a letter of variance. The generator cycles weekly for about 10 minutes and runs during power outages. The unit is low decibel (65-68 dB) [cite: 162-223].
Multiple Variances Sought for Shed Placement Due to Limited Storage
The applicant requested multiple area variances to place a 10x20 shed on their property in an RR3 zone. Variances needed are an 11.2 ft side setback (20 ft required) and a 26 ft stream setback (74 ft proposed vs. 100 ft required). The applicant has a small house (990 sq ft) and limited storage, including their garage. The proposed shed location is the most feasible, is near a retaining wall which is the only lawn area, and is situated away from the road and neighbors. The pad will be installed with a gravel base by Tri County Excavating and will not affect the stream or neighboring property. The shed will be farther from the stream than the house is [cite: 233-297].
Extension Granted for Front Setback Variance Due to Permit Delays
The applicants requested an extension for a previously approved variance related to a 43.5-foot front setback. They were unable to obtain a building permit within the original one-year timeframe. The planning board approved the variance in November, and the applicants have been working with builders since then but haven't finalized a plan. They aim to secure a building permit before November of the current year. No other aspects of the project have changed [cite: 327-369].
