City Council Seeks Guidance on Rezoning of 32-Acre Parcel for Heavy Industrial Use
The City Council discussed a rezoning petition from Two-Star Enterprises for a 32-acre parcel located west of 1255 East Beecher Road. The petitioner seeks to rezone the property from its current 'AG' with special use to 'M2 heavy industrial use' to operate a truck and semi-trailer storage facility, with potential for related industrial uses. The property is not currently contiguous to city boundaries, and the petitioner is not interested in annexation. The council's guidance was sought regarding annexation, a pre-annexation agreement, or providing recommendations to Kendall County, which is reviewing the rezoning request. Staff recommended proceeding with feedback to the county rather than pursuing annexation or a pre-annexation agreement.
Final Plat Approved for 154 Townhomes in Grand Reserve Units 10B and 11B
The City Council approved an ordinance approving the final plat of subdivisions for Grand Reserve units 10B and 11B. This represents the final phase of development for these units, consisting of approximately 154 new townhomes. Unit 10B will include 76 townhomes, and Unit 11B will include 78 townhomes. This 20-acre site is located south of the BNSF Railroad and east of Kennedy Road. Phase one of the development is currently underway, with approximately 50% built out as of March. The council was reminded that final plats reflect previously authorized preliminary plats and annexation agreements from 2003.
City Council Approves Amended Annexation and PUD Agreements with Pioneer Development LLC
The City Council approved two related ordinances concerning Pioneer Development LLC. The first ordinance approves the first amendment to the annexation agreement between the city and Pioneer Development LLC, which required six votes to pass. The second ordinance approves a memorandum of understanding (MOU) regarding a planned unit development (PUD) agreement and a utility and infrastructure agreement with Pioneer Development LLC, which required five votes to pass. Both motions carried.
Water Loss Increases Despite Infrastructure Upgrades; IDNR Reassesses Metrics
The City Council received an update on the water audit and non-revenue water reduction efforts. Despite significant investment in water main improvements over the past few years, the water loss percentage has increased from 14% to 19%. This increase is attributed to breaks in older systems caused by pressure from new pipe installations. However, when accounting for breaks and water loss from these improvements, the actual water loss is down to approximately 13% from the previous year. The Illinois Department of Natural Resources (IDNR) is reviewing its 10% water loss metric, recognizing that system age and improvement investments influence water loss. The IDNR anticipates no issues with the city connecting to the Lake Michigan water project in 2028, provided the current improvement plan continues. The council was informed that other long-standing Lake Michigan water users also exceed the 10% water loss threshold.
City Council Approves Plan for Cannonball Estates HOA Transition
The City Council approved a motion to move forward with a proposed Cannonball Estates Homeowners Association (HOA) transition plan and resident engagement process. The HOA had previously informed the city that it would stop maintaining public areas within the subdivision, which is a violation of development agreements. The city has been performing maintenance since then. It was discovered that the HOA was never properly formed, leading to its informal operation and subsequent disbandment. The proposal requires unanimous consent from all 111 homes in the subdivision to form a new HOA. If successful, the city will 'write off' the costs of maintenance incurred over the past year. If not, the city will continue maintenance through the end of the year and then levy a special service area (SSA) tax annually on residents.
