Key Ordinances Regarding Administrative Code and Civil Service Rules Postponed for Further Review

Ordinance 21-2026, which amends administrative code, fee schedules, and building code, was scheduled for a fifth reading and public hearing due to its urgency and to ensure all council members were present for the vote. Updates were provided regarding the Library Board, which is governed by state code and not explicitly mentioned in city ordinances, making it incongruous to apply remote meeting restrictions. Information on state code regarding hiring processes and civil service rules was also provided for informational purposes. The council will revisit this ordinance after a break.

Upper Arlington Police Detail Use and Safeguards of License Plate Reader Technology

The Upper Arlington Police Division presented an update on their use of Automated License Plate Recognition (ALPR) systems, also known as FLOCK cameras. Lieutenant Jason Omweg detailed the technology's capabilities, including collecting license plates, date and time, camera location, and basic vehicle attributes like color and brake light configuration. He emphasized that the system does not collect personal information, names, phone numbers, addresses, or biometric identifiers. The presentation outlined the timeline of FLOCK camera implementation in Upper Arlington, starting with six cameras in 2021 and increasing to twenty by 2024. The system is used to generate faster leads for investigations, save staff time by providing easily accessible data, and contribute to safer neighborhoods by providing real-time vehicle tracking. Specific case examples were provided, including locating missing endangered adults, recovering firearms and ammunition after a discharge of firearm incident, and apprehending a wanted murderer. Concerns regarding privacy and potential for data misuse were addressed, with assurances that data is anonymous unless linked to a criminal investigation, audited monthly, and subject to CJIS and NCIC training for officers. Data retention is set at 30 days, with all unused data being deleted. Council members raised questions about the potential for de-anonymization, data sharing, and the implications of FLOCK's terms of service. Lieutenant Omweg stated that data is only combined with a case number upon an officer's request for a criminal investigation, and federal sharing requests are disabled. The system's connection to LEADS for alerts on protection orders, warrants, and stolen vehicles was explained, as well as its use for sex offender registration checks. The council also discussed the 'Carpenter' ruling regarding location data warrants and the 30-day data retention period, with assurances that searches require a case number and justification, and queries exceeding a week would necessitate a warrant. The contract with FLOCK expressly forbids the sale or use of data for purposes other than law enforcement. Concerns about potential changes in FLOCK's terms of service were addressed by emphasizing the city's contractually binding terms and legal review. The system's limitations regarding searching for specific bumper stickers or non-license plate related information were clarified. The discussion also touched upon the distinction between FLOCK as an investigative tool versus general surveillance.

Upper Arlington Council Approves Sidewalk Projects Amidst Tree Removal Concerns

The council discussed and passed resolutions regarding the installation of sidewalks on Suffolk Road and Baldridge Road, both to be paid for by special assessment. For Suffolk Road, the resolution passed, moving forward with staff permission to put the project out to bid to determine actual costs. This action starts a two-week period for residents to be formally notified of objections or claims for damages. For Baldridge Road, a similar resolution was discussed, with concerns raised by residents about the removal of 11 out of 15 mature street trees. While the initial petition stated no trees would be removed, design plans now indicate removals are necessary. Residents and council members expressed a desire to explore options for meandering the sidewalk to save trees, possibly involving easements outside the right-of-way, though this could increase costs and require retaining walls. Staff indicated openness to case-by-case evaluations for saving trees. The process allows residents to withdraw their support before the construction contract is awarded. Tree replacement plans involving the forestry department were also discussed.
