Variances for Expanded Garage and Workshop Approved at 194 Dix Hills Road
The Zoning Board of Appeals granted an application for variances at 194 Dix Hills Road to legalize an expanded detached garage with an unheated workshop and an elevated side deck. The garage was originally permitted in 1946 but enlarged without a permit, encroaching into the side setback (5.16 ft where 10 ft is required). The workshop is for hobbies and storage, not habitation. The board granted relief for the 5.16 ft encroachment and the expanded garage with workshop, subject to conditions of no habitation.
Unheated Workshop and Portico Legalized at 19 Keeler Street
The Zoning Board of Appeals granted an application for Mr. Omar Mendoza at 19 Keeler Street, Huntington, to legalize an unheated workshop within his detached garage and a front portico. The workshop was created prior to the owner's purchase and is intended for hobbies and storage, not habitation. Similar applications for habitable space in garages have been approved by the board in the past. The board granted the application with conditions of no habitation, including no heat or plumbing.
Retaining Wall Variances Approved for Jason Court Properties
The Zoning Board of Appeals granted an application for retaining walls at 4 adjacent properties on Jason Court, Dix Hills. The walls were constructed too close to the property line (6 ft and 1.75 ft where 10 ft is required). The walls are necessary to support the yard and a fence enclosing a pool. No adverse impact on neighbors or adjoining properties was noted.
Zoning Board Approves Legalization of Retaining Wall and Decks
The Zoning Board of Appeals granted an application to legalize three existing items at 515 Caledonia Road, Dix Hills: a masonry retaining wall, a front deck, and a rear deck around a pool. The retaining wall has a maximum height of 6.6 ft and is 2.2 ft from the side lot line where 10 ft is required. The front deck is located in the required front yard setback, and the rear pool deck is 5.2 ft from the rear property line where 10 ft is required. The board found these structures did not devalue surrounding properties or alter the community's development pattern.
Existing Garage Replacement Approved at 66 North Creek Road
The Zoning Board of Appeals approved an application to replace an existing detached garage at 66 North Creek Road with a new one of the same size and footprint. Due to steep terrain, relocating the garage to a conforming location would be impractical and costly. The existing garage has a certificate of occupancy and has been on the property for approximately 81 years.
