Council Denies Appeal, Approves 27-Unit Single-Family Development on Ocean Bluff Way

The Council heard an appeal regarding the Planning Commission's approval of a 27-unit single-family development at 501 Ocean Bluff Way. The appellant raised six issues including bluff encroachment, geotechnical adequacy, drainage, lot design, affordability, road design, and traffic safety. Staff presented detailed responses to each appeal issue, supported by technical studies and engineering reviews. The appellant argued the timeline was rushed, key evidence was withheld, and the project had significant safety concerns related to bluff stability and drainage. The applicant highlighted the project's compliance with state housing laws, inclusion of affordable units, preservation of open space, and the thorough review process. After extensive deliberation and public testimony, the Council voted 4-1 to deny the appeal and adopt the Planning Commission's approval, with some conditions, including further evaluation of soil samples in a specific quadrant, and a commitment to discuss incorporating native trees around the property boundaries. Councilmember Lines cast the dissenting vote.

Encinitas Approves Annual Fee Adjustments for Planning, Engineering, and Outdoor Dining

The City Council approved resolutions to update planning and engineering development processing fees and the outdoor dining right-of-way usage fee for Fiscal Year 2026-27. The adjustment of 3.8% is based on the Consumer Price Index (CPI) increase for calendar year 2025. This CPI adjustment is an interim measure, as a comprehensive user fee study is underway and expected to be presented in Fall 2026. The outdoor dining fee, implemented in June 2024, was also adjusted by 3.1% last year and is indexed to CPI. Staff estimated the total fiscal impact of these CPI adjustments to be approximately $65,000.

The council considered a Memorandum of Understanding (MOU) with the San Dieguito Union High School District for the school crossing guard program for the 2026-27 school year. Public speakers and the school district superintendent expressed support for the revised MOU, particularly the addition of a crossing guard at Parkdale Lane.
