San Marcos Adopts Indexed Increases for Development Impact, Housing, and User Fees

The City Council reviewed and adopted Resolution 2026-9632, which enacts indexed increases to development impact fees, inclusionary housing in lieu fees, and user fees. These adjustments are intended to account for inflation and rising costs since the last fee update in late 2024, ensuring that fees can cover the cost of services. The increases are based on the ENR Construction Costs Index (CCI) for construction-related fees (2.7% increase) and the Consumer Price Index (CPI) for general business expenses (3.2% increase). Staff presented the proposed increases as necessary for fiscal sustainability and to maintain the city's purchasing power for infrastructure and affordable housing needs. For example, the single-family residential impact fee will increase from $6.70 to $6.88 per square foot.

San Marcos City Council Denies Appeal Against North City Residential Development

The City Council heard an appeal concerning Tentative Subdivision Map (TSM) 24-0004 and a related street vacation, which proposes to subdivide 19.83 acres into three lots for 202 multifamily condominiums within the University District Specific Plan area. The appellant, Elizabeth Santos, argued that the city should stay all project entitlements due to ongoing litigation involving related entities and alleged safety violations. She claimed that the city's approval of entitlements, while property owners are in litigation with the developer's related entities, unfairly depletes housing allocations and creates permanent equitable damage. Staff responded that the TSM and litigation are unrelated, the project is within the approved density for the specific plan, and the safety allegations are not relevant to the TSM approval. Staff recommended denying the appeal. The Council voted 4-0-1 to deny the appeal.

San Marcos City Council Denies Appeal Against North City Master Sign Program

The City Council heard an appeal regarding a master sign program for the North City area within the University District Specific Plan. The appellant, Elizabeth Santos, raised concerns about administrative bad faith, unlawful delegation of authority, unmitigated physical impacts (specifically grade discrepancies and height limits), objection to administrative review, documented site hazards, and the need for integrated project review with ongoing litigation. Staff responded that the master sign program was approved per the specific plan, did not approve specific sign locations, and that signage in the public right-of-way is subject to permits and does not require private property owner consent. Staff also stated that height is measured from the base of the sign at its location and that the program is within the scope of the certified final Environmental Impact Report. Staff recommended denying the appeal and upholding the Planning Commission's decision. The Council voted 4-0-1 to deny the appeal.
