Council Approves First Reading of R2 to R3 Rezoning for Bethany Meadows Twin Home Development Amidst Covenant Discussions
The council considered the first reading of Ordinance 762, which proposes to rezone tracks 10 and 11 from R2 to R3. The applicant, Bethany Meadows, represented by Joel Engel, seeks this rezoning to accommodate the construction of twin homes, as the current R2 zoning does not allow for the desired density. A deed restriction was proposed by Bethany Meadows to exclusively permit twin home use in perpetuity, addressing concerns raised by the Planning and Zoning (PNZ) committee regarding potential future transitions to higher-density uses like multi-story apartment buildings. Brian Hybr, a member of the PNZ, expressed personal concerns about setting a precedent for high-density development adjacent to existing acreages and noted the PNZ's recommendation was a 'do not pass' due to concerns about uncontrolled future development post-rezoning. Staff confirmed that rezoning is a legislative act and cannot be conditioned. Deb Herbolt, CEO of Bethany, emphasized their commitment to senior living and the proposed twin home development as an extension of their existing community, highlighting the demand for such housing and the covenant to restrict the land use. Resident Joe Baron spoke in favor, citing the need for senior living options. The council debated the enforceability of deed restrictions and the potential for future sale of the property. The construction timeline was discussed, with hopes to begin grading and utility work soon after approval. A motion was made and seconded to approve the first reading, contingent upon the filing of covenants and restrictions. The vote resulted in passage with a motion and second to approve, with further discussion on the enforceability of covenants and the timeline for construction.
Medical Cannabis Insurance Requirement Reduced from $2 Million to $1 Million Following Second Reading
The council discussed the second reading of Ordinance 761, which amends medical cannabis regulations by lowering the insurance requirement for cannabis licenses from $2 million to $1 million. A motion and second were made to approve the ordinance. The vote passed with 'ayes'.
Block Party Request Approved; Annual Fireworks Display for Bethany Meadows Greenlit
A request for a block party was approved, with all affected property owners signing off on the application. The council also approved Bethany Meadows' annual request for a fireworks display on July 10th in coordination with the Brandon Fire Department.
Ironwood Extension Bid Awarded to Site Works; Pioneer Lift Station Payments Approved
The council reviewed bids for the Ironwood Extension project. Out of 11 bidders, Site Works submitted the lowest bid at $1.17 million, which was approximately 35% lower than the engineer's estimate. The council approved the bid, and the contractor is expected to begin work within the week. Additionally, the council approved pay application number one for the Pioneer Lift Station project, totaling $97,993, and pay application number two for $15,193. Both pay applications were noted as being well below the estimated costs.
Council Rejects $10,000 Bid for Former Convention Center Property, Citing Undervaluation
The council discussed the potential sale of Lot 1A in Burkeman's Track, a former convention center attached to the Holiday Inn. The bonds for the convention center were defeated and paid off by tax increments. The property was declared surplus and advertised, receiving only one bid of $10,000. The assessor's office valued the property at approximately $1 million. Council members expressed concern that $10,000 was an inadequate bid and suggested rejecting it. They proposed exploring a short-term lease with Holiday Inn or obtaining a commercial appraisal to determine a fair market value. Concerns were also raised about the limited potential use of the property due to its dependence on the Holiday Inn Express parking lot and a mutual access easement. The council ultimately voted to reject the $10,000 bid.
