Plan Commission Dismisses Zone Map Change Petition for Former Military Museum Site
Petition 22:25, a zone map change from I1 to I2 Industrial at 2304 Crystal Street, the former military museum, was dismissed. The item had been tabled since December due to lack of progress by the petitioner, Kelly Drews. The commission discussed concerns about the clarity of a letter sent to the petitioner regarding potential zoning changes upon remodeling and potential brownfield issues. Ultimately, the decision was made to dismiss the petition, with staff to follow up with an email to the petitioner outlining the need to refile and go through the entire process if they wish to pursue the zone change. A motion to dismiss was made and seconded, followed by a roll call vote.
Commission Members Discuss Setbacks and Zoning Concerns for Industrial Property Near Residential Areas
During the discussion of the Best Way's petition (implied to be related to zoning of industrial property), commission members expressed concerns about the potential for a dump or dump operation to be located near residential properties. Staff clarified that a 300-foot setback is in place, and the applicant even offered a new site plan with a 300-foot wide buffer yard. The discussion also touched upon the possibility of replatting the land to prevent future undesirable uses, with one commissioner suggesting this as a way to address concerns. Staff explained that the applicant was seeking to match current zoning with the back piece that had residential zoning, and that expanding the transfer station would require going back before the Board of Zoning Appeals (BZA). Concerns were raised about future owners having different intentions, and whether a lighter zoning category would be more appropriate if only offices were intended. Ultimately, it was noted that anything in I3 zoning requires BZA approval.
Plan Commission Continues Replat Petition for Evelyn Addition Property
Petition 5-26, submitted by PR Properties for a replat of lot 2011 in Evelyn Addition, located at the southwest corner of West Third and Locust Streets, was continued to the next commission meeting on July 28th. The item was previously continued due to the owner's absence. Last month, the owner hired an attorney who requested a continuance. This month, the attorney contacted staff indicating they had written down the wrong date for the current meeting and requested a second continuance. Staff agreed to the continuance, and a motion to continue was made, seconded, and approved via roll call vote.
Plan Commission Continues Zone Map Change Request for Dewey Street Property
Petition 6-26, ordinance 826, submitted by Nadj Dimatus for a zone map change from R2 residential to R3 residential at 1425 Dewey Street, was continued to the next plan commission meeting. This item was previously continued last month to allow the owner more time to provide clarification on changes to create a duplex and a list of items requested by staff. The owner's architect recently requested an additional 30 to 60 days for design of plans. Staff agreed to the continuance, and a motion to continue was made, seconded, and approved via roll call vote.
