Waxhaw's Board of Commissioners Meeting - June 23, 2026 6:30PM

Town Adopts Updated Personnel Policies After Extensive Review
The town has undergone a comprehensive review and update of its personnel policies, initiated in October 2025 with Central Regional Council as the lead consultant. Staff provided feedback in December 2025, followed by drafting by Central, which took several months. Further staff and town attorney reviews occurred in April and May. A high-level overview was presented to the board on June 9th, and a final review and discussion were held. The updates primarily involved minor language changes, reorganization, and consolidation of various policies into a single, easily navigable document with a table of contents. Key additions include compliance with the Pregnant Workers Fairness Act and the ADA. A new state statute requires fingerprint-based background checks for positions working frequently with children, such as parks and recreation staff, which may lengthen the hiring process. The updated policies are set for adoption on July 14th, 2026, with subsequent staff training planned.
Board Debates Policy for Opening Meetings with Prayer or Invocation
The board engaged in a detailed discussion regarding the implementation of a policy for opening public meetings with a prayer or invocation. Legal counsel advised on constitutional parameters, particularly the Establishment Clause, and relevant case law, emphasizing the need for content neutrality and avoiding governmental establishment of religion. Several options were considered, including allowing any individual to sign up, establishing a rotating schedule, and having a default plan (moment of silence or a board member/staff offering the invocation) if no one signs up. Concerns were raised about potential legal challenges, the practicality of managing sign-ups, and ensuring the process does not favor any particular faith. The discussion also touched on the duration of the invocation (suggested one minute), whether participants must be residents, and the prohibition of promoting specific religions or churches. The policy aims to provide an opportunity for voluntary participation while maintaining legal compliance.
Town Properties to be Declared for Economic Development Following Legal Review
The board discussed the procedural steps necessary to convey town-owned properties at 321 North Broom Street and 316 North Church Street for economic development purposes. Legal review indicated that historical records do not clearly establish if these properties were acquired under the statute allowing conveyance for economic development. The town attorney recommended formally declaring these properties as being held for economic development purposes. To achieve this, staff proposed a public notice, a public hearing, and the adoption of a resolution declaring the town's intent under NCGS 158-7.1. Following these steps, a Request for Proposals (RFP) can be finalized and issued to market the properties in line with previously discussed economic development objectives. The board was asked to approve directing the town clerk to prepare legal advertisements and schedule a public hearing for July 14th, 2026.
