Conditional Zoning Process Policy Discussion Continued; Focus on Transparency and Deliberation Time

The council discussed a proposed revision to the conditional zoning process policy. The goal is to provide greater transparency and allow council members more time to understand projects before neighborhood meetings. The proposed policy would repeal the existing subcommittee policy and establish a formal review process through town council meetings. Under this new approach, after the public hearing and initial presentations, the council would typically defer a decision to a subsequent meeting, allowing for further deliberation and negotiation. This is intended to provide more time for council members to digest complex proposals. The council also debated the possibility and legality of ad hoc committees and one-on-one meetings with developers versus formal subcommittee meetings, considering the open meetings law. The discussion on the policy was tabled to July 13th to allow for further consideration and input from absent council members.

Council Votes Against Expanding Mail Notification Radius, Opts for HOA Outreach

The council discussed the town's mail notification radius for development projects. While the current 500-foot radius exceeds state statute requirements, council members expressed interest in expanding it to 1,000 feet. Staff presented data showing that doubling the radius would significantly increase workload and costs, reaching over double the properties for mailings. They also noted that current notification methods, including neighborhood meetings and public hearings, have resulted in high public participation. Staff recommended maintaining the 500-foot radius but suggested two optional enhancements: notifying HOAs within the radius and expanding digital outreach. The council ultimately directed staff to maintain current standards but pursue HOA notification within the 500-foot radius. A motion to pursue this approach received a second but failed to pass due to lack of full council support.

Council Approves Text Amendment for Wireless Telecommunication Standards

The council considered a text amendment (TX26.05.01) to correct formatting errors in the town's development ordinance related to wireless telecommunication facility standards. A technology glitch in June 2021 inadvertently removed these standards, which are required by North Carolina General Statute 160D. The proposed amendment restores Article 10.1-34 to its original state and renumbers one standard to 38. The planning board recommended approval, and staff also recommended approval, stating the amendment corrects a formula error and restores compliance with state law. The council approved the text amendment unanimously, finding it consistent and reasonable with the comprehensive land use plan.

Lawyers Road Commercial Rezoning Application Continued by Council

The council reviewed a conditional rezoning application (CZ26.02.02) for a 1.23-acre parcel at 14721 Lawyers Road, proposing a non-residential commercial and office development. The property's current zoning is single-family residential one, with a request to rezone to conditional zoning mixed-use two. The site plan has undergone revisions to address concerns about buffering, screening, building placement, and impacts on adjacent residences. The planning board recommended denial, citing issues with the sidewalk, buffering, parking, and inconsistency with the future land use plan. Staff recommended approval, noting improvements in compatibility and support for the economic development plan. The public hearing was continued to July 13th due to the limited number of voting council members present and a desire to allow for further discussion and potential inclusion of neighborhood protection conditions. A draft architectural commitment was prepared, and the applicant agreed to match the style of the Harris Heater Shopping Center.

Town Adopts Stricter Open Burning Ordinance to Enhance Safety and Air Quality

The council considered proposed amendments to the open burning ordinance (Chapter 95) to improve clarity, consistency, and enforceability, aiming to enhance public safety, fire prevention, air quality, and community health. The current ordinance has enforcement gaps, particularly concerning the burning of household debris and construction materials, and does not authorize police to enforce violations after hours. The proposed revisions would prohibit all open burning unless specifically exempted, remove land clearing and right-of-way maintenance burning as permissible activities, retain exemptions for campfires and outdoor cooking under certain conditions, authorize code enforcement and police to enforce the ordinance, and revise penalties. The council unanimously approved the amendment, finding it consistent with town goals for public health, safety, and quality of life.
