Deeds Raise Concerns Over Zoning Violations and Property Disputes on Laurel Boulevard
Laura presented deeds concerning a four-unit apartment building on Laurel Boulevard. She raised concerns about Lot Number Two, which was zoned for off-street parking for the apartment building, being deeded separately to Arthur Harris III and then to Boone Management Company. Laura stated that this subdivision and dual deeding of the lot violated city and state zoning codes, as no formal subdivision occurred. She also noted encroachments from neighboring properties and questioned the validity of tax collection based on these deeds. The City Solicitor agreed to investigate the matter with zoning.
Jeffrey Dunkel Appointed to Recreation Commission
Jeffrey Dunkel was appointed to the Recreation Commission for an unexpired term. The nomination was supported by Mayor Smith, who noted Dunkel's experience with handicapped children and playgrounds. The appointment passed with a unanimous vote.
Council Considers New Ordinances for Fiscal Accountability, Meeting Efficiency, and Public Access
Councilmember Price proposed several new ordinances aimed at increasing transparency and fiscal accountability, including the 'Possible Competitive Procurement Fiscal Accountability Act,' 'Pottsville Efficient Council Proceedings Act,' 'Pottsville Alcohol Safety Awareness Act,' and the 'Pottsville Freedom of Education Access Act.' The competitive procurement act requires departments to annually review their top five vendors. The efficient council proceedings act aims to streamline meetings by minimizing recesses. The alcohol safety act prohibits alcohol in city facilities except for special events. The education access act grants equal access to public facilities for educational institutions. The proposed ordinances faced scrutiny regarding their legality, necessity, and potential costs.
Recreation Commission Ordinance Faces Legal Scrutiny; Appointment Compromise Discussed
An ordinance amending Chapter 9, Article 3, regarding the Recreation Commission membership and officers was presented. Councilmember Price proposed a compromise: if Jeffrey Dunkel were nominated for a Rec Committee opening later, the ordinance would not be voted on next month. However, the Solicitor expressed concern that the proposed ordinance might violate state law, as state law dictates the mayor appoints members to the recreation commission. The mayor declined to commit to a vote on Dunkel's nomination.
Police Department Under Budget, Chief Appeals for Consideration of Krasno Building Purchase
The Police Department's financial report indicated they are under budget, with a projected year-end of $3,742,984.84. No major budget strains have occurred. However, the training budget is over, with expected reimbursement from Pennsylvania for two trainees in the police academy. Chief Morrow also made a personal appeal to council regarding the Krasno building, highlighting the poor working conditions for officers and urging serious consideration of the purchase.
