Retreat Outdoor Space Relocation Approved with Mitigation Measures
A conditional use request to modify previously approved conditions for a retreat at 1336 South Rogers Street was recommended for approval by staff and PNZ. The original condition required the outdoor event space to be in the southeast portion of the property, but this area contains wetlands. The applicant proposes moving the pavilion to a more central location and establishing a 20-foot buffer with a berm to mitigate impacts on adjacent residences. New conditions include restrictions on hotel/motel use and ensuring the buffer and berm are implemented.
Kreitz GMC Dealership Site Plan Approved with Street Sign Condition
Four site plans submitted in 2026 will be approved by staff (Ms. Johnson and Mr. Lloyd) under the new process, not by the city council. The first of these is for Kreitz GMC car dealership on Polar Parkway in Clear Lake Way (C2 Heavy Commercial Zoning District). Staff recommended approval with a condition that existing, unapproved street name signs be removed and replaced with approved ones prior to the pre-construction meeting.
City Workshop Held on Impact Fee Ordinance Implementation
The city is holding a workshop on Ordinance 02026-03.c concerning impact fees. Impact fees are designed to ensure new growth and development contribute proportionally to the cost of capital improvements. The city is awaiting feedback from the state (DCA/CRC) on their impact fee study, which is expected to be finalized and potentially adopted in July. The ordinance, once approved, will allow for the full implementation of impact fees based on a schedule derived from a consultant's methodology. Key provisions include benefit districts, definitions, fee schedules, individual fee determinations, fund usage, credits, exemptions, refunds, appeals, and annual reviews.
Mobile Italian Ice Business Approved with Storage Conditions
The Planning and Zoning Commission (PNZ) and staff recommended approval, with conditions, for a conditional use request at 1114 Forest Drive for a home occupation business involving mobile Italian ice sales. The condition requires all business storage to be within the garage or behind the fence and not visible from the street. The applicant agreed to remove a storage container from the property.
Culver's Variance Approved for Drive-Through Canopy Expansion
Staff and PNZ recommended approval for a variance request at 121 Tanger Outlet Boulevard for Culver's to expand a non-conforming canopy. The existing canopy is within the 60-foot adjacent street setback. The canopy was approved in 2017 but is non-conforming according to current code. The variance allows for the expansion of this drive-through canopy to accommodate a double-lane setup.
