Fremont City Council Denies Lead Applicant Role for Rail Infrastructure Grant Amidst Concerns

The Fremont City Council considered a resolution to authorize the city to act as the lead applicant for a Consolidated Rail Infrastructure and Safety Improvement Program grant on behalf of Rail Modal Group (RMG). The grant, administered by the Federal Railroad Administration, requires a local government partner for entities like RMG. Staff expressed initial hesitation due to potential liabilities and concerns about RMG's financial assurances, specifically their provision of a bank balance letter instead of an escrow account or letter of credit for the $5 million match. A key development was the verbal offer from the Nebraska Department of Transportation (NDOT) to administer the grant if awarded, which would shield the city from direct involvement. However, concerns were raised by council members regarding the rushed timeline, incomplete information provided by RMG, potential impacts on future city grants, and the lack of RMG representatives at the meeting. Discussions also touched upon past issues with RMG regarding LB 840 funding, easement requests, and safety violations. Despite assurances from city staff and legal counsel regarding indemnification agreements, some council members remained uneasy about the financial risks and the company's business practices. Ultimately, the resolution to approve the city as the lead applicant failed with a 5-3 vote.
