Elk River Approves $6M+ GMP for Northbound Construction Project

The City Council approved a Guaranteed Maximum Price (GMP) of $6,020,589 for the northbound construction project, which includes the construction of a new store. This GMP covers the building construction itself and does not include fixtures, furniture, and equipment (FFE), which are estimated at an additional $750,000. The city plans to bond for the project later in the summer or early fall. The project utilized a Construction Manager at Risk (CMAR) process, where subcontractors were pre-qualified and selected through a vetting process prior to the bid conclusion. The GMP represents the final price from the CMAR for the construction of the building.

Home Occupancy Permits Withheld for Tall Pines Development Due to Unresolved Stormwater Issues

The City Council discussed the ongoing issue with the Tall Pines development regarding a stormwater pond that does not function as an infiltration basin as originally designed. Despite a previous ordinance amendment last June to allow the wet pond and a condition requiring engineering updates to meet state stormwater standards, the work was not completed according to plans stamped by a qualified civil engineer. Consequently, the city is withholding Certificates of Occupancy (COs) for nine homes. The developer, Roger Derrick, has engaged a new engineering firm and anticipates providing certified plans within 90 days. The Council, citing the prolonged nature of the issue and lack of progress, decided to continue withholding all nine COs until the certified plans are submitted and approved by city engineering, rejecting the developer's request to release four COs.

Elk River City Council Approves Expanded Business Park Uses, Denies Others

The City Council considered a comprehensive ordinance amendment for the Business Park Zoning District, aiming to adapt to evolving commercial markets. The amendment sought to allow several new uses, including outpatient medical facilities, physical recreational training, wholesale printing and publishing, repair services, increased warehouse space, health and fitness clubs, and indoor commercial dog kennels. The Planning Commission recommended allowing outpatient medical facilities, wholesale printing/publishing, and repair services, but opposed physical recreation, increased warehouse space, health/fitness clubs, and dog kennels due to concerns about impact on industrial land, employment, and land use conflicts. The Council ultimately adopted Ordinance 2615 to permit outpatient medical facilities, printing and publishing, and repair services as permitted uses. They also directed staff to prepare findings of fact to deny requests for physical recreation and training, health and fitness clubs, dog kennels, and removal of warehouse limitations. However, the council also voted to allow physical recreation or training and health and fitness clubs as an interim use permit (IUP) through a separate motion.

Outpatient Medical Facilities Now Permitted in Elk River Business Park

The City Council reviewed and adopted an ordinance amendment to permit outpatient medical facilities in the Business Park Zoning District. This amendment allows for uses such as traditional medical and rehabilitation facilities that were not previously permitted. The Planning Commission had previously recommended approval. A specific applicant, Lyft PT, spoke in favor, highlighting the need for higher ceilings and warehouse-like spaces for their boutique clinic, which are not available in current medical facility zoning.
